Data Collection Exercise

The Local Authority Engagement team’s (LAET) data collection exercise is now complete and all 326 local authorities in England have been visited since the General Election.

The results will now be analysed in detail and have already informed the next steps of the LAET and the procurement currently being planned.  Early indications are that LLC registers contain less paper data and more digital data than envisaged at the beginning of the Programme. 

Thank you to all local authority LLC team members and colleagues who assisted this exercise.

Procurement

Activities will soon take place to secure the partners that will support Land Registry’s (LR) LLC programme, with the current emphasis on the tender documents for the forthcoming Planning and Delivery Partner procurement.  These documents will be published shortly, following which, potential suppliers will submit tenders and presentations will be made to LLC programme board.

Field Fisher has been appointed as LR’s external legal support to work alongside our legal advisors on all LLC procurement activities.

New Burdens

As you know, LR has committed to establishing the New Burdens Working Group, in order to ensure that the new burdens assessment process is transparent, accurate and fair.  

We have spent the last few months working with LGA to agree an outline approach to the assessment process and we are now at the point of establishing the working group.

The purpose of the group will be to provide input into the overall burdens assessment, consider reasonable evidence and develop a methodology for calculating burdens payments. 

The group will consist of: LR, LGA, LLCI, DCLG and 6 local authorities (Leeds, Pendle, Craven, Kettering, Medway, and Kensington & Chelsea).  LLCI asked for volunteers to be part of the Working Group and local authorities were chosen to give a broad representative sample.

Areas for consideration by the group include: data preparation, migration support, applications to register new charges, IT and applications to vary or cancel existing charges (after migration).

LLC Rules Consultation

The Infrastructure Act 2015 provides for the transfer of responsibility for local land charges in England and Wales from local authorities to Land Registry. Under these provisions, Land Registry will provide a single, digital local land charges register.

To implement the changes, secondary legislation is required which will be subject to a public consultation.  The purpose of the consultation is to seek views on the draft Local Land Charges Rules – these Rules have been scrutinised by an independent LLC Rules Review Panel (comprising representatives from LGA, Law Society and the Ministry of Justice) who have undertaken a technical review of the Rules.

The consultation will be relevant to Land Registry customers, stakeholders and others who have an interest in the property market and will be announced once we have received government approval to publish. 

Recruitment

Roles to join LR’s LLC team as Programme Manager and Business Change Manager have recently been advertised both externally and across the Civil Service. Interviews are intended to take place shortly. 

Local Authority Engagement

Following the data collection exercise the LAET will spend the first part of the year focussing on three areas:

A separate group will conduct engagement to enhance LR’s information on the LLC services that have been outsourced outside of local authorities.
A second group will identify and engage with bodies (other than local authorities) that create LLCs, including County Councils, to look at their processes and potential impact of the changes.

Finally, the next phase of Local Authority engagement will also begin, with a team conducting meetings with local authority LLC teams, to identify tasks that will require completion before migration of the service. This work will begin in February in London.

LLC Training and Development Event

A small number of senior LR staff will attend this event in Bristol to provide an update, run information sessions and answer delegates questions between 13:30 and 15:15 on the afternoon of Tuesday March 1st  2016.  The following team members will be attending the event:

LOCAL AUTHORITY UPDATE 

BURDENS

Land Registry has already started to actively look at new burden payments and a new working group is being established with the Department for Communities and Local Government (DCLG), Local Government Association (LGA), Local Land Charges Institute (LLCI), a number of local authorities and Land Registry.  The purpose of the group is to determine how payments to local authorities could be calculated, how they will be paid and to ensure that there is transparency in the calculations.  The assessment will be agreed by Land Registry, DCLG and HM Treasury.

The group will meet on a regular basis and more details will be released as the burdens work progresses through the relevant stages within Government.  At this stage it is the intention Land Registry will fund data preparation prior to migration, migration support and the ongoing effort to ensure that the register is kept up to date once the service is live. 

REGISTER SERVICE - BUILD APPROACH

Land Registry will create a centralised, digital, open LLC register, comprising:

  • A spatial database for storing LLC extents and attributes including associated text
  • A user interface for updating and querying the register
  • Application Programming Interfaces (APIs) for updating and querying the register
  • Land Registry will provide LLC search results from the centralised register

REGISTER SERVICE – SERVICE OPERATION

Land Registry’s current thinking is that as a digital service, the register will be updated by originating and local authorities using the provided digital interfaces.

Local Land Charge notices will be created, amended, and removed using either:

  • a manually driven web interface 
  • or, automatic updates using local authority software

Existing local authority software will require changes to push updates to the register service as they are made. These updates will require a minimum level of detail before they are accepted by the register; this will comprise a spatial charge identifier (a polygon or point), and attributes associated with the charge as defined by the Local Land Charge rules (defined in secondary legislation).  

The register service will only reveal charge notices that the central service has been informed of by local authorities or originating bodies. i.e. there will be no requests from the central service to local authorities or originating bodies to request further updates or data.  Access to LLC register data will be open, permitting spatial data queries.  

Access to the register service operations that result in a change to the register will be restricted. Access will be granted on a self-administration basis with primary accounts being created by Land Registry and subsequent accounts being created and administered by the primary account holder for each local authority and originating body.

LLCI Conference update

As you will know, members of the Land Registry team were present at the recent LLC Training & Development event in Bristol.

A general update on the current position was provided on day one, followed by speed sessions on:

  • Legislation & policy
  • Stakeholder engagement
  • Digitisation


Many of you have attended our Digital Transformation Days and feedback from those events have shown that people feel more comfortable asking questions in smaller groups and that they have more opportunity to do so.  In light of this, the speed sessions were designed to split delegates into smaller groups, in order to give delegates the opportunity to ask questions to members of the Land Registry team.

On the second day the team fed back to all delegates, following the speed sessions on day one.  

We also informed you all that we will be meeting shortly with both the LLCI Board and Local Government Association, to discuss how we take our working relationship forward.
These discussions have already begun and both the sessions we ran and the concerns you have told us about, have given us, the LGA and the LLCI a foundation to build upon.

Additionally, we asked delegates to provide written questions and while we only received a small number we have provided the answers below to the LLCI Board, for circulation to members. 

  • What contingency do you have in place if LLC Officers leave the service? 

Ultimately each Local Authority has an obligation to maintain the service up until transfer.  However we will be working closely with Local Authorities, LGA and LLCI to ensure that Local Authorities can properly plan for the transfer of the service, now that following Royal Assent we have moved into the planning and development stage.  Proper planning will ensure a smooth transition of the service give certainties to Local Authorities and staff.

  • Quote from LR presentation today ‘Ensure delivery of a solution – as we cannot damage the private sector’.  This appears to favour the private sector/personal search companies? 

This answer applied to the work undertaken in relation to Con 29. Feasibility work has been undertaken in respect of Land Registry providing a Con 29 solution. As you all know, private search companies provide a variety of search products including Con 29. If Land Registry, as a government department chooses to enter a market where a service is supplied by the private sector, it must consider the impact on that sector and on the current environment.

  • What address base will you use? Have you spoken to the National Land & Property Gazetteer? Will you attach charges to UPRNs? 

This is yet to be determined as the service has not yet been developed.  However, as we move forward with the procurement and development stages, we will ensure that Local Authorities can input into this and that they are kept up to date with any developments.

  • How/Why does LR think it will be successful creating a single register for 348 authorities when some new unitary authorities have still not been successful after 6 years? 

Land Registry has undertaken extensive work on Local Land Charges over the last few years, including the running of a successful prototype, customer research and wide-ranging stakeholder engagement.  Moving forward, we will be working closely with LLCI, LGA and other Government Departments, in order to ensure successful migration of the service. Additionally Land Registry has created and runs the Land Register, a database holding more than 23 million titles. Its expertise in managing a register of this kind is why the government believes we are best placed to become the single registering authority for Local Land Charges. 

  • There has been no mention of liability.  Can Land Registry confirm where liability will lie and will this be in the Secondary Legislation? 

Yes, the final details of liability will be contained in the secondary legislation and will be the subject of discussion with the Local Land Charges Advisory Board. We will also seek views from Local Authorities but the final view will need to be discussed with HM Treasury.

The current thinking is that Land Registry will provide a guarantee for the LLC searches it provides to customers. If a financial loss is incurred due to an incorrect result being supplied, Land Registry will rectify that loss.  However, ultimate ownership of the data will remain with the Local Authority and if the data is not kept up to date and provided to Land Registry and a loss is incurred due to absent information in the data, liability will fall to the Local Authority and Land Registry will seek to recover the rectification it has made. This liability model is well understood and accepted by customers.

Legislation will address how Local Authorities will be obliged to keep the register up to date. It will also be addressed as part of a legal protocol between Land Registry and Local Authorities.

  • How do you propose to automate the LLCR when we know it is open to interpretation (that is what we do as LLCOs)?  Where is the local knowledge that was mentioned and recognised earlier? 

It is clear that there will need to be a large element of data preparation in order for the service to be migrated.  Land Registry will work with LLCI and LGA to ensure that data is captured accurately, including any ‘local knowledge’.  From the process mapping work completed to date with some volunteer Local Authorities and also the data collection exercise currently being undertaken, we have in each case to date, found source data with Local Authorities, for what can be termed ‘local knowledge’.  Further work will be completed in each Local Authority in this area, so that we can determine the part that ‘local knowledge’ plays.

  • If the Local Authority is to maintain the original data, how is it going to be recompensed for this burden in the future?  How are you to ‘pay’ recompense to the LA for the initial time spent with your ‘Engagement Team’?  (Our time is money and we have limited resource especially at a time when we are required to save money and increase our own income streams)

Land Registry will work with LLCI, LGA and Government Departments on a new burdens assessment for the migration of the service.  It is our working assumption that this will consider any effort required by Local Authorities for on-going work.  However, it should be noted that any new burdens assessment is overseen and agreed by Government.

  • What did you hope the outcome would be by engaging with Local Land Charge staff here in Bristol? 

We attended the Bristol event at the invitation of both the LLCI and Land Data.  It was our intention to provide an update on the current position following Royal Assent, to pick up on those issues that have been highlighted as key areas of interest by Local Authorities, to give delegates a chance to ask questions in smaller groups and to set out the next steps.

Data Collection Exercise
Following Royal Assent of the Infrastructure Bill, it will be necessary for Land Registry to collect more detailed information regarding the format, quantity, and location of the data which comprises the Local Land Charges Register, in each local authority.

In order to achieve this, we have approached approximately 30 local authorities and requested a meeting to explore these questions. Due to the level of detail we now require and the possible complexity of the records, this exercise may take longer than previous meetings.

Following the Purdah period (see below) it is intended that this exercise will be completed in all local authorities.

What detail do we require?
We need to know the following, in respect of each of the 12 parts of the Register:

  • The number of LLC registrations
  • The format(s) in which the data is held
  • An assessment of the records (both in terms of the confidence in the accuracy and completeness of the data, and in terms of the physical condition of the records which comprise the Register)
  • The location of the data

Where the records are held in digital format, we will need to establish the number of registrations held in the system, and the number of related spatial representations (polygons or UPRNs).Where the records are not in digital format, we will need access in order to perform a count (or at least a sample count, if the number is too great).We may need to speak with other departments within the authority, if they hold Local Land Charges Register data.

The information collected will inform the digitisation process and help to obtain best value when procuring suppliers to conduct digitisation and migration of the Register data. Your co-operation in this matter is greatly appreciated, and will make a valuable contribution to ensuring that the proposals are delivered in an efficient and effective way.

Purdah

As you may be aware, we will be entering a period of ‘purdah’ from the end of March until after the General Election in May, when the new Government has formed. 

There is specific guidance for such periods immediately before elections which restricts the activity of civil servants, to prevent any bias during this time.  This means that as an organisation, Land Registry will not be able to carry out any stakeholder engagement during purdah. 

Land Registry’s Local Authority Engagement Team will be in touch with you again, following the formation of any new Government after the General Election.

Land Registry and Local Authority Engagement
Land Registry has begun contacting local authorities (LAs) to arrange an introductory meeting to discuss the proposed transfer of the statutory Local Land Charges (LLC) service. While we appreciate these meetings are being requested prior to the legislation receiving Royal Assent and the progress of the Bill is still continuing through Parliament, the meetings are crucial to the ongoing relationship between Land Registry and Local Authorities.  Senior Managers and LLC officers are currently being approached and a separate letter has been issued to local authority Chief Executive Officers.

It is our intention to be as open as we possibly can in this early engagement and to assist this, the LLCI board has kindly agreed to post updates from Land Registry on this website.

This post will explain the background to these initial meetings and hopefully answer some of the questions that you may have regarding our approach.

What is happening now?
Over the last two years a small Land Registry team has engaged with over 200 LAs and many other stakeholders. This group has now been extended to form a ‘Land Registry Local Authority Engagement Team’ that will visit all 348 LAs in England and Wales.

This team consists of three LA Relationship Managers and nine LA Co-ordinators. Each team member has been assigned an allocation of LAs and the early emphasis has been on meeting with previously un-visited LAs and those that participated in the prototype. 

Land Registry has listened to feedback that our early approaches (particularly by e-mail) have lacked detail.  We consider that both the importance of the LLC service and the contribution of LLCI members over many years mean that ‘face-to face meetings’ are appropriate.

What are the purposes of this first meeting?
The first meeting has two purposes; firstly it will provide an opportunity to introduce the Land Registry contact responsible for engagement with each LA. It is intended that this person will remain this contact for the duration of the project, although this could be subject to change.

Secondly, Land Registry is completing a basic ‘profile’ on each LA in order to further develop costs, timescales and implementation planning.

In addition, Land Registry recognises that the process of preparing and transferring data will place a burden on each LA and to help alleviate this, we are seeking to provide some financial assistance. We are therefore looking to collect information to prepare a ‘burdens assessment’ which will form the basis of discussions to agree this funding with the Department for Communities and Local Government (DCLG).

What will Land Registry ask?
At this stage the information required by Land Registry is of a basic nature and will include questions on the following:

  • How each LLC register is held, including the mix of paper and electronic data.
  • Software providers.
  • Fees.
  • Staffing levels.  
  • Average turnaround times.
  • Methods of lodgement, post, email, NLIS etc.

The Land Registry contact will also explain the current position of the project and will be available for any questions that arise from the meeting.

Prototype

To date the two Land Registry teams have processed approximately 1,000 new charges and added them to our prototype register. They have also processed over 2,000 searches and these continue to be checked for accuracy against the official search results. The result matching process has shown that approximately two thirds of searches match the official search results and out of the prototype Local Authorities, the highest match rate on average is 88%. Reasons for mismatches include some data gaps, data cleansing being done at the time searches are processed and some elements of records being in paper format. Work has been ongoing for some time with the Local Authorities to explore the reasons behind these and the solutions.

We have now almost completed digitisation of all of Watford’s records. The card records have been digitised, numbering 10,465 cards and over 15,500 charges, including Planning charges. There were a small number of charges that could not be digitised initially, for example where the record was illegible or the extent affected was ambiguous. Work has been ongoing with Watford to digitise these remaining records.

The LLC prototype will end at the end of November as planned. The evaluation reports from each individual workstream within the project are being finalised in preparation for presentation to Land Registry’s Board.

Con29

The following was posted by Rhonda Griffiths on this forum and remains the current situation in respect of CON29.

Land Registry are working with a number of private companies as a result of the Market Warming Day looking at a range of options for CON29 and how this could be delivered in the future. There are mock ups/demos as a result of this work with various companies but no fully working CON29 prototype – the details currently remain commercially sensitive whilst we define a way forward. Our thinking hasn’t changed – we still don’t intend to build or hold a CON29 database.

Engagement

The engagement team have now met with 221 Local Authorities individually to discuss the proposals. We have also now contacted every Local Authority in England and Wales, giving details about the proposals and FAQs, as well as offering individual meetings if required. Prototype

The prototype system continues to be used by our teams at the Birkenhead and Croydon Land Registries. To date we have added over 750 new charges to our Register and processed over 1,500 searches. When checking our search results against those produced by the local authorities, a number of mismatches in the number of charge entries revealed have arisen which are due to missing data – this is being investigated with the software suppliers and prototype authorities. We continue to digitise the Watford data and have now completed 61% of all of their records (over 9,000 charges). This work will continue throughout the remainder of the prototype. We are exploring options to digitise some of the data at Swindon & Denbighshire.

We have now completed all of our prototype demonstration events and hopefully, these have given many of you an opportunity to not only see what has been built but also given you an insight into some of the Land Registry systems too.

Engagement

We have now met individually met with over 200 Local Authorities. These meetings continue and are valuable in helping to us to build up that picture of what data exists etc. All of the information from the individual meetings is being fed back into the prototype and if we haven’t visited your Local Authority yet, you can contact us at llcproject@landregistry.gsi.gov.uk

Research

The Ipsos Mori research has been completed and submitted to Land Registry. This is currently being analysed and will be released as part of the final evaluation report.

Focus Groups

We are currently running a number of Focus Groups, to ensure that we are consulting properly with our stakeholders and getting as much feedback as possible on the proposals. Four Focus Groups have been established as follows:

Local Authority Focus Group – made up of Local Authorities representatives including Local Land Charges Officers, Senior Managers from different Local Authority departments and GIS experts. The purpose of the Focus Group is to gain a greater understanding as to how the proposals may impact upon Local Authorities, consider the potential benefits and issues and to explore how the service could be delivered in futurePersonal Search Company Focus Group – made up of a group of Personal Search Company representatives to look at the impact of the proposals on their current business models and how we could move forwardLand Registry Customer Focus Group – consists of Land Registry conveyancer customers to provide an insight and feedback into the planning, implementation, delivery and future direction of both LLC and CON29Local Government Focus Group – made up of representatives from DCLG, LGA, LLCI and Local Authority Chief Executives to look at the potential impact of the proposals across Local Government

Market Warming Day

Following the Market Warming Day, work continues with the private sector exploring the proposals that have been put forward.These cover digitisation for LLC and also future options for CON29. Until this is complete, these remain commercial in confidence.

Prototype

The LLCI Board have now received a demonstration of the prototype, as have those people who have attended our
‘show and tell’ dates in Croydon, Durham and Birkenhead in the last two weeks. As of now, we are parallel processing applications for all prototype Local Authorities. The casework teams at both Birkenhead and Croydon Land Registry offices are involved in this. We are continuing to digitise data from Watford and explore all possible ways of doing this efficiently. Now that processing is fully underway with the prototype Local Authorities, we will look at the results produced by Land Registry and validate these against the official results and independently, to check their accuracy. We are also now spending time investigating how register updates are received, how we interpret and register them. We will be
continually improving the functionality of the prototype system as processing continues and feedback is received.

Local Authorities

Rhonda, Sam, Mark, Paul and Graham are still travelling across England and Wales, attending regional meetings and
visiting as many individual Local Authorities as possible. We have now individually met over 160 Local Authorities and some County Councils. We have another 30 already booked for the coming months. We have now made contact either individually, or at events, with the majority of Local Authorities. These meetings are quite informal and give you the
opportunity to ask questions about the prototype, so if anyone else would like to arrange a visit, please contact us at llcproject@landregistry.gsi.gov.uk

Thank you to those Local Authorities who have already met with us, we are feeding back any issues raised into the
prototype and the information provided is helping to build up a picture as to the many types of records and processes used for this service.

Market Warming Day

We are following up on the market warming day held last month with private sector software and digitisation suppliers, to explore possible opportunities for collaboration and this work remains ongoing. Suppliers have now had time to submit any proposals and these are being considered in detail for both LLC and CON29. 19 suppliers were invited and we have to date received 15 proposals.

Local Government

We have met with the LGA recently to discuss the proposals with them and these meetings have been very constructive. LGA support the digital delivery of services and we will continue to engage with them as we move forward. We are also meeting with Local Authority Chief Executives and will be setting up a ‘working group’ of Chief Executives, who can input into the project.

Personal Search Market

Research

The independent research being conducted by Ipsos MORI (as mentioned in previous updates) remains ongoing and the results will form part of the final report. (NB: Ipsos MORI adheres to the MRS Code of Conduct and Data Protection Act and all recording of responses are strictly confidential and are not attributable to those interviewed).

Prototype

The Local Land Charges prototype is now being used by our two operational teams in Birkenhead and Croydon offices to dual process LLC searches. We have started to receive searches in on a daily basis from Denbighshire and over the course of the next two weeks, we will bring on board the other prototype Authorities. Ongoing improvements will continue to take place until the end of the prototype following feedback from the teams as they process the work. We also making good progress with digitising the data from Watford Council.

The prototype authorities have now visited Land Registry to see what we’ve built and how it works and we received a number of positive comments about the demonstration. Additionally, both the LLCI Board and Government Digital
Services have also had a chance to view the system.

As you know, we have arranged several ‘show & tell’ dates to which you are all invited:

Croydon Land Registry – Weds 17th July
Durham Land Registry – Tuesday 23rd July
Birkenhead Land Registry – Weds 24th July
Croydon Land Registry – Weds 18th Sept
Wales (venue to be confirmed) – Weds 25th Sept
South West @ Plymouth Future Inn – Thurs 26th Sept
Nottingham Land Registry – Monday 30th September

At these dates, we’ll be giving a demonstration of what’s been built and how it works etc. The dates are open to all, though due to the anticipated high level of demand, we will have to restrict numbers to only one person from each Local Authority. I’ll be putting together a formal agenda and timings over the next few weeks but if you’d like to register to come along to one of the events, please contact us at llcproject@landregistry.gsi.gov.uk with your preferred date and location. We’ll try to get as many people as possible in.

Engagement

Our Local Authority Engagement Team remains out on the road meeting with Local Land Charges Officers on an individual basis and attending as many regional group meetings as possible. The Engagement Team, Rhonda Griffiths, Mark Edwards
and Sam Heath have now made contact with over 200 Local Authorities and have attended in excess of 120 individual
meetings with Local Land Charges Officers. This work is helping us to understand the wider picture of data that is out there so that this information can all be fed back into the prototype. If we haven’t yet visited your Local Authority, please do contact us, it’s very informal and we just have a few questions – we’re also happy to provide an update and take your questions too. Research

The independent research being done by Ipsos MORI remains ongoing with lenders, conveyancers, personal search companies and Key Opinion Leaders with the land and property sector. This is so that we can gain a deeper understanding of the user(s) needs of Local Land Charge searches and to test ideas/improvements in their processes. The research will
be compiled into the final evaluation report at the end of the prototype. This will run until the end of August.

Market Warming Day

The first of Land Registry's market warming events has also taken place so that Land Registry can invite the market to look at all options for collaboration. Companies involved in the supply of software and digitisation solutions attended and there was a lot of positive interest in how the proposals could be taken forward. Those companies that were in attendance now have a period of two weeks where they can put together any proposals that they may have, how they might be able to contribute with the digitisation of LLC and/or provision of CON29 data.

Personal Search Market

We continue to actively engaging with the Personal Search Market and have contacted all CoPSO and IPSA members regarding the proposals. Individual meetings will take place with those that want further information and to discuss the prototype in more detail.

Prototype

The Local Land Charges prototype has now been developed and has been released to two operational teams in our Birkenhead and Croydon offices. Ongoing improvements will continue to take place until the end of the prototype following feedback from the teams as they begin to process searches. The register contains data from Sefton, Liverpool and Denbighshire. Next week we will begin the digitisation of LLC data from Watford Council. We are working with the software suppliers to extract data from Swindon, Newark and Sherwood and Havant. The dual processing of searches will begin in the next few weeks. Our IT development is one month ahead of schedule.

Some of the prototype authorities have now visited Land Registry to see what we’ve built and how it works, the remaining authorities are coming in next week for a similar day. Additionally, we’ll be demonstrating the system to the LLCI Board at their next meeting in June.

Following on from this, we have pushed back the original ‘show & tell’ dates to the following dates:
