Updated CON29 Guidance Notes published by the Law Society September 2019

As you may remember from Branch meetings, LLCI and Land Data have been working with the Law Society to update the CON29 Guidance notes to reflect some recent changes in SuDS and Compulsory Purchase Orders. 

These updated Guidance notes were published on the Law Society web site on Friday 27th September 2019.

LLCI strongly advises that all local authorities use these guidance notes and review the changes to ensure that responses to the CON29 remain accurate and current.

This updated guidance provides a good opportunity for all local authorities to carry out a data audit of  CON29 responses to ensure all the relevant information is being provided.

The notes are issued by the Law Society in consultation with Land Data/National Land Information Service and the Local Land Charges Institute.

They are intended to provide guidance to:

  • solicitors and conveyancers when interpreting replies
  • local authorities when replying to CON29 and CON29O enquiries of local authorities

The notes have been updated to take account of the changes:-

  • to the legislation on compulsory purchase orders in 3.12 and
  • in relation to Sustainable Drainage Systems (SuDS) in 3.3 in:
  • England – discussions around compulsory SuDS coming into force are ongoing
  • Wales – the SuDS regime is now mandatory in Wales for new developments built under planning permissions granted following applications made after 7 January 2019
